Lost Earning Capacity

When a person is seriously injured and some aspects of those injuries are permanent and cannot be completely resolved, it is very important to have a thorough evaluation of how those injuries will affect a person’s ability to continue earning a living.  In the litigation process, once it is known that there are permanent aspects to the injury a vocational consultant can be contacted to perform an evaluation.  This evaluation would look at the injured person’s limitations or restrictions and the extent of any disability in determining how a person’s job or career will be impacted.  Sometimes a person must be re-trained and find an entirely new career pursuit.  Other times a person must scale back their hours or job duties.

What is clear is that the impact that serious injuries have on the ability to continue making money, a so-called vocational or lost earning capacity claim, must be thoroughly evaluated in order to ensure successful outcomes and put the injured person into the best position possible.
